Welcome to Shrido, the carpooling app that connects Drivers and Passengers for shared transportation. These terms and conditions ("Terms") govern your access to and use of the carpooling platform provided by our mobile application Shrido – Share and Go.
Please read these Terms carefully. By accessing or using the app, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the app.
"Carpool App" refers to the mobile application “Shrido – Share and Go” and its associated functionality provided by our company, Ride Shrido Pty Ltd (also referred to as “we” and “us” in these Terms).
"User" refers to any individual who accesses or uses the Carpool App. A User may be either or both of a Driver and Passenger.
"Driver" refers to a User who offers to provide transportation through the Carpool App.
"Passenger" refers to a User who requests and uses transportation through the Carpool App.
To use the Carpool App, Users must be at least 18 years old and possess the legal capacity to enter into a binding agreement. By accessing or using the Carpool App, Users confirm that they meet these requirements.
a. The Carpool App is a platform that connects Drivers with Passengers for the purpose of sharing transportation. The Carpool App enables Users to create profiles, request rides, and offer rides to other Users.
The Carpool App is intended for personal, non-commercial use only. Users are encouraged to share rides to reduce travel costs, minimise environmental impact, and promote a community-driven approach to transportation.
b. Users acknowledge that the Carpool App only provides a platform for facilitating carpooling. We do not own or operate any vehicles and are not responsible for the actions, conduct, or safety of Drivers or Passengers.
c. Users are solely responsible for arranging and completing rides through the Carpool App. Users agree to comply with all applicable laws and regulations related to transportation and carpooling, and ensure that they possess the necessary licenses, permits, and insurance.
d. We act as a facilitator in the provision of carpooling. Shrido does not provide transportation services directly and is not responsible for any agreements or disputes between Drivers and Passengers. Our role is to provide a platform for Drivers and Passengers to connect and make their own transportation and carpooling arrangements.
a. Users agree to provide accurate, complete, and up-to-date information during registration and when using the Carpool App. Users are responsible for maintaining the confidentiality of their login credentials and for all activities that occur under their account.
b. Users agree to behave respectfully and courteously towards each other. Users shall not engage in any illegal, offensive, or discriminatory behaviour during rides facilitated by the Carpool App.
c. Users agree to use the Carpool App solely for its intended purpose and not to engage in any unauthorised or fraudulent activities. Users shall not attempt to manipulate or interfere with the functioning of the Carpool App or its associated systems.
d. Location Data: Users agree to provide consent for the Carpool App to access and use their location data for purposes including, but not limited to:
• Driver Notifications: Providing notifications when a driver is nearby, even when the User's screen is off.
• Trip Tracking: Accurately tracking rides from pick-up to drop-off, including when the app is running in the background.
• Route Matching: Matching routes of Drivers and Passengers for ride-sharing purposes by checking for overlapping journeys.
Users acknowledge that location data is essential for the operation of the Carpool App, and some features of the app may not function properly if location permissions are not granted.
a. Drivers must maintain their vehicles in roadworthy condition and comply with all relevant laws and regulations, ensuring the safety of passengers.
b. Drivers are required to provide accurate vehicle information and update it as necessary.
c. Drivers must adhere to our policies, including the Community Standards as notified by us from time to time.
d. Drivers must not have any license suspensions, major traffic violations, or alcohol/drug-related incidents within the past 5 years.
e. Drivers must not have any criminal convictions or pending criminal cases.
f. Drivers must be at least 18 years old, and hold a full unrestricted license (i.e., no P plates or provisional licenses).
g. Drivers are only permitted to earn enough to cover the running costs of their vehicle, as calculated by the daily earning limit form provided by Shrido. Earnings should not exceed the operational expenses associated with carpooling (e.g., fuel, maintenance, and general vehicle wear and tear).
h. Drivers are not permitted to use Shrido for profit or as an occupation. The platform is intended solely for social carpooling purposes, and drivers should not rely on or use Shrido as an income source.
a. The Carpool App facilitates payments between Drivers and Passengers for shared transportation services. Users acknowledge and agree that the Carpool App may collect and process payments on behalf of Drivers.
b. Drivers subscribe to use the platform and are required to pay a subscription fee.
c. Passengers have the option to purchase points using the Carpool App, which can be exchanged for rides. The cost and availability of points are determined by us and may be subject to change. Passengers are responsible for ensuring the availability of sufficient points to cover the cost of their rides.
d. Passengers may accumulate points on their Carpool App account, and any points exchanged for a ride will be deducted from the Passenger's point balance.
e. Drivers will receive the value of the points used by the Passenger in exchange for the provided ride. Drivers can accumulate points based on rides completed.
f. Drivers may redeem accumulated points for gift cards offered by us. Passengers are not eligible to redeem points for gift cards. The availability and options (and associated terms) for gift card redemption may be determined by us and is subject to change.
g. We will provide the necessary information and process for Drivers to claim and receive their chosen gift card upon redemption of points. Drivers acknowledge and agree that the redemption of points for gift cards is subject to the terms and conditions set by us.
h.Users agree to indemnify and hold the Carpool App harmless from any claims, damages, or liabilities arising out of or in connection with the purchase, use, or redemption of points through the Carpool App.
a. Users acknowledge that the Carpool App is provided on an "as is" and "as available" basis. The Carpool App does not guarantee the availability, reliability, or quality of any transportation services offered through its platform.
b. The Carpool App shall not be liable for any direct, indirect, incidental, consequential, or exemplary damages arising out of or in connection with the use of the Carpool App.
c. Nothing in these Terms excludes, restricts or modifies any condition, warranty, guarantee, right or remedy implied by law (including the Competition and Consumer Act 2010 (Cth)) and which by law cannot be excluded, restricted or modified.
a. Drivers are responsible for ensuring that they have the necessary insurance coverage for their vehicles and passengers.
b. Drivers must understand their insurance obligations and coverage, including liability for accidents or incidents during carpooling trips.
Drivers must follow a code of conduct, including respectful behaviour towards passengers, adherence to our policies, and compliance with all relevant laws and regulations.
a. We handle driver information in compliance with Australian laws and our Privacy Policy, which is available at https://shrido.com.au/privacy-policy/.
b. Users consent to the collection, use, and sharing of their location data as outlined in these Terms and in the Privacy Policy. Users can manage location settings through their device's privacy settings but acknowledge that disabling location permissions may limit the Carpool App's functionality.
a. User-Initiated Account Deletion: Users may request to delete their account at any time by pressing the "Delete Account" button within the Carpool App.
• Warning Pop-Up: When a user initiates account deletion, a warning pop-up will appear detailing that all personal information and
accumulated Shrido points will be permanently deleted if the process is completed. Users will have the option to cancel the
deletion and reach out to us at support@shrido.com.au if they wish to claim the equivalent value of their points in the form of a
gift card before proceeding with the deletion.
• Forfeiture of Points Upon Account Deletion: If the user selects "Yes" to confirm the deletion, all accumulated points will be
forfeited and permanently deleted along with their personal data. Additionally, the user's identity will be anonymized for certain
retained data, such as ride history and transaction history, to ensure app operations are not disrupted.
• Gift Card Arrangement: If the user selects "No" and contacts support@shrido.com.au, Shrido will arrange for the remaining points
to be converted into an equivalent gift card value before proceeding with the account deletion.
b. Company-Initiated Termination: We reserve the right to terminate or suspend access to the Carpool App at any time, without prior notice, for any reason, including repeated policy violations, failure to meet service standards, or other reasons as determined in our discretion.
• Monetary Value Arrangement for Points: If Shrido terminates a user's account, we will organize the monetary value of any accumulated points in the form of gift cards, provided all other terms and conditions have been met. This ensures that users do not lose the value of their points due to company-initiated termination.
c. Retention of Certain Data: Non-personal or anonymized data, such as trip history or payment records, may be retained for legal, compliance, and operational purposes but will no longer be linked to the User’s identity. Any financial transaction records or dispute history will be retained as required by law (e.g., for tax or regulatory compliance).
d. No Recovery of Account or Points Upon User-Initiated Deletion: Deleted accounts and any associated Shrido points, if the deletion is initiated by the user and confirmed via the warning pop-up, cannot be recovered. If Users wish to use the Carpool App again, they must create a new account.
e. Notification of Account Deletion or Termination: Users will receive an email confirmation of their account deletion or termination, providing details on which data was removed, including confirmation of the status of any Shrido points, and any data retained for legal or compliance reasons.
The Carpool App reserves the right to modify or update these Terms at any time. Users will be notified of any material changes to these Terms. By continuing to use the Carpool App after the revised terms become effective, Users accept and agree to the updated terms.
By accepting these Terms and using the Carpool App, Users agree to indemnify and hold us, our affiliates, and each of their officers, directors, other users, employees, and agents harmless from and against any and all claims, costs, damages, losses, liabilities, and expenses (including lawyer’s fees and costs) arising out of or in connection with their use of the Carpool App.
These Terms shall be governed by and construed in accordance with the laws of Victoria, Australia. Any disputes arising out of or in connection with these Terms shall be resolved through amicable negotiations. If a resolution cannot be reached, the parties agree to submit to the jurisdiction of the courts of Victoria, Australia.
